This policy covers all subsidiaries of SERT as specified in the Organisation Chart.

This policy complies with the Conduct of Employment Agencies and Employment Business Regulations 2003 (the ‘Conduct Regulations’), specifically regulation 13A, which introduced the requirement to provide a key information document for agency workers, which took effect from 6th April 2020.

The purpose of this policy is to ensure SERT provide transparency of information for agency workers using a key information document, particularly around pay, prior to their agreeing employment terms. The key information document will give a clear idea of how any fees and deductions will affect their pay and allow agency workers to make an informed decision about accepting employment. The key information document will also include contact details for the Employment Agency Standards (EAS) inspectorate and ACAS.

SERT will issue a new key information document each time any revisions are made to key information. SERT will also supply a copy of the key information document when requested by an agency worker within 5 working days of the request.

Agency worker relationship (PAYE)

SERT will include the following information in the key information document based on a three month pay period:

· Name of worker

· Contract type

· Identity of the employment business

· Who will pay the worker

· Rate of pay

· Pay intervals

· Statutory deductions

· Non-statutory deductions

· Any fees for goods or services

· Any other benefits

· Leave entitlement

The key information document will also include a representative sample statement, which will show how all deductions and fees will affect the proposed rate of pay over a three-month period. This will be a clear worked example that demonstrates the pay the agency worker will receive from the assignment using real numbers and methods of calculation. These figures may be estimated and do not need to reflect the specific rate of pay the agency worker will receive, but they should demonstrate in a realistic way the deductions made to a proposed rate of pay and how these affect the agency worker’s take home pay.

The representative sample statement will include the following:

· The gross amount to be paid to the worker over three months

· Any statutory deductions to pay

· Any non-statutory deductions to pay

· Any fees to be charged to the agency worker for good and services, stating whether the payments are on-offs or ongoing

· The net remuneration payable to the worker after all deductions and fees

Agency worker and the use of an umbrella company

SERT will include the following facts in the key information document based on a three month pay period, which will clearly show any umbrella company margin or deductions:

· Name of worker

· Contract type

· Identity of the employment business

· Name of umbrella company

· Who will employ the agency worker?

· Who will pay the agency worker?

· Any business connection between the employment business and the umbrella company

· Pay intervals

Umbrella Company pay information:

· Rate of pay received from the employment agency

· Statutory deductions form umbrella company income

· Non-statutory deductions from the umbrella company income

Worker pay information will include:

· Pay rate

· Statutory deductions

· Non-statutory deductions

· Any fees for goods and services

· Any other difference between the umbrella company’s income and the agency worker’s net pay

· Any other benefits

· Leave entitlement

· Any opt out agreements under Regulation 32

Personal Service Companies

Where an intermediary or umbrella company is controlled by the worker or their spouse or civil partner, this normally means the agency worker is engaged as a personal service company (PSC) and that the additional information is not required.

SERT will include the following facts in the key information document based on a three month pay period for agency workers who sign on with an employment business through a PSC.

· Name of worker

· Contract type

· Identity of the employment business

· Who will pay the worker?

· Rate of pay

· Pay intervals

· Statutory deductions

· Non-statutory deductions

· Any fees for goods or services

· Any other benefits

· Leave entitlement

Agency workers engaged as a PSC can opt out of the rest of the Conduct Regulations, providing both the company and the worker agree, unless they are being supplied to work with, or care for, vulnerable persons. They cannot opt out of regulation 13A.
